What Is a Chargeback?

Every time you use a credit card or debit card you are initiating a transaction that is controlled and regulated. If it’s a Visa or Mastercard, your transactions are governed by terms and conditions that they adopted and published. These terms and conditions define rights and obligations for you, your bank, the merchant, and its bank.For example, if your card was lost or stolen and you see unexplained transactions on your account, you can immediately request your bank to reverse the charges. Visa and Mastercard mandate your bank take that action to protect you from fraud. Even when you willingly make a purchase, you are protected should your purchase not materialize or you receive something other than what was promised.

Chargebacks related to fraud

The first case in which a chargeback is granted is credit card fraud or bank transfer. This is simple to prove and easy to understand. If you lose your credit card and someone picks it up and starts shopping, it's a fraud. You are not responsible because it is an unauthorized transaction. If you report the loss to the issuing bank, they will credit your account, according to local laws. In the United States, for example, federal law limits your liability to a maximum of $ 50 if you report the fraud within two business days. If you do this after two business days but within 60 days you could be charged up to $ 500. If you wait more than 60 business days you could be held responsible for the full amount.
Another example of credit card fraud is if you use your credit card to purchase a specific item that is not delivered as contracted. Suppose, for example, you buy a new equipped computer online. You have clearly specified its technical specifications. Then, after accepting the delivery, you open the box and find that it contains an inferior model. Or a used one. Or a toaster. You have not received the item you authorized. You call the merchant but they deny they sent you the inferior model. Or the one used. Or the toaster. They just don't help. If so, the trader has scammed you. Your bank will promptly recognize a credit card dispute and agree to cancel the transaction. You clearly deserve a chargeback.

Service related chargebacks

The second of two cases in which a chargeback is justified is when a service is not provided as contracted. In general, it is much more difficult to justify a chargeback when it is related to the service. After all, unlike a clear case of credit card fraud, you're not disputing that you authorized the purchase. Admit you did. And you are not disputing that the merchant provided a service. What you are claiming is that the precise service you contracted was not provided by the merchant. But can you prove it?

This challenge is much easier said than done. After all, you signed a contract. You've probably also provided the merchant with a number of additional documents to establish your identity. This means that he can sue them to prove that you voluntarily entered into a business relationship with him and knew exactly what you were doing.
Can you justify a chargeback for the service yourself?
In all likelihood, it took a few months before you realized you hadn't received the service you contracted. You did not notify your bank immediately, as you would if you lost your credit card or were a victim of credit card fraud.
